Respected SIR,

We(me, my wife and elder son) are eligible to apply for permanent residency in March 2010. Ore younger son was born here in UK in July 2009. We do not intend to go home(India) before applying for permanent residency.
I would like to know whether we need to apply for visa for our younger son so that he also gets permanent residency status, along with three of us. Can the home office refuse to grant my younger son permanent residency stauts because he doesn't have visa stamped on his pasport? A reply would be highly appreciated.

Dear Sheen,
Thank you for your e mail.
It is not a strict requirement to have your son’s dependant visa stamped in order for him to apply for ILR. The requirement is that you will need to prove that he is your son who is applying as your dependant for ILR. In your case you will be able to prove the same by producing the documents such as your son’s birth certificate etc.
